If you have an idea for an invention, you need to hire a patent attorney as soon as possible to protect your rights. Patent attorneys are registered with the USPTO (Patent Office) and understand the laws and rules for working with an Examiner to have a patent issue for an invention.
Can I work with a Patent Agent?
Yes, but a patent agent is not allowed to practice law. A patent agent can only write patent applications and respond to office actions. Typically, a patent agent will not have a full understanding of the patent laws that may apply. Even if they do, a patent agent is not allowed to give legal advice or advise you on the patent laws.
Do I need to hire a Patent Attorney in my state?
It is up to you whether you work with a patent attorney in your state. Patent law is federal, and therefore even a Colorado patent attorney who is registered with the Patent Office can give legal advice concerning the patent law regardless of where you live.
