The term “inventor” is a legal definition under the Patent Law. Inventors conceive of an invention.
All inventors must be named on the patent application. However, those who did not actually make an inventive contribution cannot be named. For example, you cannot name your supervisor or employer as an inventor merely as vanity. They must have actually made an inventive contribution.
By default, an inventor is the owner or “applicant” for a patent application. However, an inventor may be required to assign their rights in the patent application to their employer.
Check your employment agreement and talk to a patent attorney before filing a patent application on your own.
